Pre-litigation
Investigation & Pleadings • Goal: Determine legal claims, gather facts, and file the complaint • Key Actions: Client intake and factual investigation • Legal research and pre-filing demands or negotiations • Work with former law enforcement to conduct investigations. Draft and file the complaint • Service of process • Defendant responds with an answer, demurrer, or motion to dismiss
Discovery
• Goal: Exchange and uncover all relevant information to support claims and defenses • Key Actions: Written discovery: interrogatories, requests for production, admissions • Depositions of parties and witnesses • Subpoenas to third parties • Expert retention and disclosure • Discovery motions to compel or protect as needed
Pre-Trial
• Proceedings Goal: Narrow the issues and attempt resolution before trial • Key Actions: Motions for summary judgment/adjudication • Motions in limine to exclude or limit evidence • Settlement conferences or mediation • Final pre-trial conference and exchange of trial documents
Trial
